No. Psilocybin is a Schedule I controlled substance under Washington law, and possession has been a gross misdemeanor since July 2023. But six cities and counties now treat it as a low priority. Here's the county-by-county picture, and how ordering works statewide.
No. Washington lists psilocybin and psilocyn in Schedule I of its controlled substances act, and knowingly possessing any amount has been a gross misdemeanor since July 1, 2023.
That 2023 law (SB 5536) set the penalty at up to 180 days in jail, a $1,000 fine, or both, with up to 364 days possible after two prior convictions. It also encourages prosecutors to offer pretrial diversion into treatment instead of a conviction, and it made using in a public place a separate gross misdemeanor with the same penalties.
None of that is touched by the local resolutions below, and federal law is unchanged too: psilocybin is Schedule I nationally. Our state-by-state legality guide covers the rest of the country.

None has legalized it, because only the Legislature can change state law. Six local governments have passed resolutions telling police and prosecutors to make entheogens, psilocybin mushrooms included, one of their lowest enforcement priorities.
| County | Local measure | Passed |
|---|---|---|
| King | Seattle: City Council Resolution 32021, lowest enforcement priority | Oct 2021 |
| King | Unincorporated King County only: council motion, passed with two no votes | Mar 2026 |
| Jefferson | Port Townsend: city resolution | Dec 2021 |
| Jefferson | Jefferson County: commissioners' resolution, unanimous | May 2023 |
| Thurston | Olympia: city resolution, unanimous | Aug 2024 |
| Pierce | Tacoma: Resolution 41609, unanimous | Jan 2025 |
| Every other county | Snohomish, Spokane, Clark, Whatcom, Kitsap, Yakima and the rest: no local measure had passed when we checked in November 2026 | None |
A resolution only covers the government that passed it. The King County motion applies to unincorporated areas, so Bellevue, Kent, Redmond and the county's other cities aren't covered unless they pass their own, and Tacoma's resolution stops at the Tacoma city line. Advocates at REACH Washington put the share of Washingtonians living under some kind of deprioritization at about 14 percent in early 2026.
Organizers have pushed for measures in Spokane and Bellingham too, but neither had one on the books when we checked. The Tacoma, Olympia and King County measures all say outright that they don't cover commercial manufacturing or sales.

Not quite. On March 24, 2026 the King County Council passed a motion asking that investigating and arresting adults for personal entheogen use be the county's lowest enforcement priority, but it covers only unincorporated King County and its sponsor said plainly, "This is not a decriminalization motion."
The motion, sponsored by Councilmember Teresa Mosqueda, also backs continued research and full decriminalization at the state and federal level. Councilmembers Reagan Dunn and Claudia Balducci voted no. Mosqueda described it as reaffirming existing practice, since the Sheriff's Office already deprioritizes personal use on its own.
It carves out driving under the influence, possession or distribution at schools, use on public transit, anything involving minors, commercial manufacturing or sales, and conduct that puts public safety at risk. Seattle, which sits inside King County, has had its own resolution since 2021.
Not yet. Washington has no licensed psilocybin program, so outside approved research nobody in the state can legally provide psilocybin; the nearest licensed access is Oregon, which licensed its first psilocybin service center in May 2023 for adults 21 and older.
A 2023 law (2SSB 5263) told the University of Washington to run a psilocybin therapy pilot for veterans and first responders 21 and older, subject to funding, and set up a state task force. UW's psychiatry department announced a trial for veterans and first responders with PTSD and alcohol use disorder that was set to begin enrolling in early 2025.
Wider bills keep stalling. A licensed adult-access framework didn't make it out of committee in 2025, and in 2026 a medical psilocybin program (SB 5921) cleared the Senate health committee on February 4 before running out of time at the session deadline. If it had passed, the program wouldn't have started until July 2028.
Not from a legal store: there's no licensed retail sale of psilocybin anywhere in Washington, and every local resolution leaves commercial sales illegal. Most people in the state who buy mushrooms order online and have them shipped.
That's what we do. My Mushroom Dispensary is based in Seattle, publishes its full catalog and prices, holds lab reports on the batches it sells, and ships to every Washington address. We've done this kind of discreet fulfillment for four years.
Anything presenting itself as a walk-in mushroom dispensary in Washington isn't operating under any legal framework, whatever its signs say. If you're in the city, our Seattle page covers ordering there.
The same as Seattle: order before 2:00 PM PT on a business day and it ships from Seattle the same business day, arriving in two business days on 2 Day Shipping ($9.99) or the next business day on Next Day Shipping ($45). PO Box orders go free by UPS Ground Saver and take a couple of days longer.
That covers Tacoma, Bellevue, Everett, Kent, Renton, Federal Way, Olympia, Bellingham, Vancouver, Spokane, Yakima, the Tri-Cities and everywhere in between. Packages are plain and unbranded, with tracking on every order.
